英國買樓退稅實例 3種退稅情況 最多個案退$30萬港元

英國買物業,除了要支付物業印花稅(SDLT),假如大家買入物業一刻並非英國稅務居民,便有機會要繳付樓價2%的海外買家印花稅。至於大家手上持有多一層物業,更有機會要再繳樓價3%的第二物業印花稅。

一般物業印花稅(SDLT)的計算方法是,25萬鎊以下物業無需繳付,如果25萬鎊至92.5萬鎊的物業的稅率是5%,92.5萬至150萬鎊物業則需繳付10%,150萬鎊以上的稅率是12%。然而首置人士的免稅門檻則升至42.5萬鎊。

假如物業超過25萬鎊,例如一層45萬鎊的物業,可以先扣除25萬免稅門檻,剩下20萬才計算5%稅率。但如果是海外買家印花稅及第二物業印花稅,則需要用樓價總額計算,即直接用45萬鎊X2%或3%,所以稅項一點也不輕。

但其實3種情況,是有機會退回已繳的海外物業印花稅或第二物業印花稅,分別是:

  1. 物業被列為不適宜居住,可視為非住宅物業,便可退回海外物業印花稅或第二物業印花。
  2. 三年內更換自住物業,可申請退回第二物業印花稅。當中租住七年的自住物業,也有機會可以退稅﹗
  3. 購買英國物業成交日,前一年或後一年內在英國住滿183天,可申請退回海外買家印花稅。
